Relevant legal bases

Relevant legal bases according to the GDPR: In the following, you will receive an overview of the legal bases of the GDPR, on the basis of which we process personal data. Please note that, in addition to the provisions of the GDPR, national data protection requirements may apply in your country of residence or country of residence. If more specific legal bases are also relevant in individual cases, we will inform you of these in the data protection declaration.

  • Consent (Art. 6 para. 1 sentence 1 lit. a) GDPR) - The data subject has given his or her consent to the processing of personal data concerning him or her for a specific purpose or for several specific purposes.

National data protection regulations in Germany: In addition to the data protection regulations of the GDPR, national regulations on data protection in Germany apply. This includes in particular the law on protection against misuse of personal data during data processing (Bundesdatenschutzgesetz – BDSG). In particular, the BDSG contains special regulations on the right to information, the right to erasure, the right to object, the processing of special categories of personal data, the processing for other purposes and the transmission as well as automated decision-making in individual cases including profiling.

Security measures

We shall take appropriate technical and organisational measures to ensure a level of protection appropriate to the risk, in accordance with the legal requirements, taking into account the state of the art, implementation costs and the nature, scope, circumstances and purposes of the processing, as well as the different probabilities of occurrence and the extent of the threat to the rights and freedoms of natural persons.

Measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical and electronic access to the data, as well as access to, input, transfer, securing availability and separation. Furthermore, we have established procedures to ensure the exercise of data subjects' rights, erasure of data and reactions to the risk of the data. Furthermore, we take into account the protection of personal data already in the development or selection of hardware, software and procedures according to the principle of data protection, through technical design and data protection-friendly presettings.

Backup of online connections by TLS/SSL encryption technology (HTTPS): In order to protect the data of users transmitted via our online services from unauthorized access, we rely on TLS/SSL encryption technology. Secure Sockets Layer (SSL) and Transport Layer Security (TLS) are the cornerstones of secure data transmission on the Internet. These technologies encrypt the information transmitted between the website or app and the user's browser (or between two servers), which protects the data from unauthorized access. TLS, as the enhanced and safer version of SSL, ensures that all data transmissions comply with the highest security standards. If a website is secured by an SSL/TLS certificate, this is signaled by the display of HTTPS in the URL. This serves as an indicator for users that their data is transmitted securely and encrypted.

Transfer of personal data

As part of our processing of personal data, it happens that these are transmitted to other places, companies, legally independent organizational units or persons or disclosed to them. Recipients of this data may, for example, include service providers commissioned with IT tasks or providers of services and content that are integrated into a website. In such cases, we comply with the legal requirements and, in particular, conclude corresponding contracts or agreements that protect your data with the recipients of your data.

International data transfers

Data processing in third countries: If we transfer data to a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if we do so in the context of the use of third-party services or the disclosure or transmission of data to other persons, entities or companies (which is identifiable by the postal address of the respective provider or if the privacy policy expressly refers to the data transfer to third countries), this is always in accordance with the legal requirements.

For data transfers to the USA, we rely primarily on the Data Privacy Framework (DPF), which was recognised as a secure legal framework by an adequacy decision of the EU Commission dated 10.07.2023. In addition, we have concluded standard contractual clauses with the respective providers, which comply with the requirements of the EU Commission and establish contractual obligations to protect your data.

This two-fold protection ensures comprehensive protection of your data: The DPF constitutes the primary level of protection, while the standard contractual clauses serve as additional security. If changes occur within the framework of the DPF, the standard contractual clauses act as a reliable relapse option. In this way, we ensure that your data remains adequately protected even if any political or legal changes occur.

With the individual service providers we inform you whether they are certified according to the DPF and whether there are standard contractual clauses. For data transfers to other third countries, corresponding security measures apply, in particular standard contractual clauses, express consents or legally required transmissions. General information on data storage and deletion

We delete personal data that we process in accordance with the statutory provisions as soon as the underlying consents are revoked or there are no further legal grounds for processing. This concerns cases where the original processing purpose is omitted or the data is no longer required. Exceptions to this regulation exist if legal obligations or special interests require a longer retention or archiving of the data.

In particular, data that must be stored for commercial or tax reasons or whose storage is necessary for the prosecution or protection of the rights of other natural or legal persons must be archived accordingly.

Our data protection notices contain additional information for the storage and deletion of data, which apply specifically to certain processing processes.

In the case of several data on the retention period or erasure periods of a date, the longest time limit shall always prevail.

If a period does not explicitly start on a specific date and is at least one year, it shall start automatically at the end of the calendar year in which the event triggering the deadline occurred. In the case of ongoing contractual relationships within which data are stored, the event triggering the deadline shall be the date of the termination of the contract or any other termination of the legal relationship.

Data that is no longer stored for the originally intended purpose, but on the basis of legal requirements or other reasons, is processed exclusively for the reasons that justify its retention.

  • Storage and deletion of data: The following general deadlines apply to storage and archiving under German law:
    • 10 years - retention period for books and records, annual accounts, inventories, situation reports, opening balance sheet as well as the working instructions and other organizational documents required for their understanding (§ 147 para. 1 Nr. 1 i.V.m. para. 3 AO, § 14b para. 1 VATG, § 257 para. 1 Nr. 1 i.V.m. para. 4 HGB).
    • 8 years - accounting documents, such as invoices and cost statements (§ 147 para. 1 no. 4 and 4a i.V.m. para. 3 sentence 1 AO and § 257 para. 1 no. 4 i.V.m. para. 4 HGB).
    • 6 years - Other business documents: received commercial or business letters, reproductions of the commercial or business letters sent, other documents, insofar as they are important for taxation, e.g. hourly pay slips, business invoices, calculation documents, price statements, but also wage invoice documents, insofar as they are not already accounting documents and cash registers (§ 147 para. 1 no. 2, 3, 5 i.c.w. para. 3 AO, § 257 para. 1 no. 2 and 3 i.c.m. para. 4 HGB).
    • 3 years - Data required to take into account potential warranty and compensation claims or similar contractual claims and rights and to process related requests based on previous business experience and usual industry practices are stored for the duration of the regular statutory limitation period of three years (§§ 195, 199 BGB).

Rights of data subjects

Rights of data subjects from the GDPR: As a data subject, you are entitled to various rights according to the GDPR, which in particular result from Art. 15 to 21 GDPR:

  • Right of objection: You have the right, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you, which is based on Art. 6 para. 1 lit. e or f GDPR; this also applies to profiling based on these provisions. If the personal data concerning you are processed for direct marketing purposes, you have the right at any time to object to the processing of personal data concerning you for the purpose of such advertising; this also applies to profiling, insofar as it is related to such direct marketing.
  • Right of withdrawal for consents: You have the right to revoke your consent at any time.
  • Right of access: You have the right to request confirmation as to whether or not the relevant data is being processed and to obtain information about this data as well as further information and copy of the data in accordance with the legal requirements.
  • Right to correction: In accordance with the legal requirements, you have the right to request the completion of the data concerning you or the correction of the incorrect data concerning you.

Use of cookies

Notes on legal bases for data protection: Whether we process personal data using cookies depends on consent. If consent is given, it serves as the legal basis. Without consent, we rely on our legitimate interests, which are explained above in this section and in the context of the respective services and procedures.

Storage time: In terms of storage time, the following types of cookies are distinguished:

  • Temporary cookies (also: session or session cookies): Temporary cookies will be deleted at the latest after a user has left an online offer and closed his device (e.g. browser or mobile application).
  • Permanent cookies: Permanent cookies remain stored even after the end device has been closed. For example, the log-in status can be stored and preferred content can be displayed directly when the user visits a website again.   • Processing of cookie data based on consent: We use a consent management solution to obtain the consent of users to the use of cookies or to the procedures and providers referred to in the consent management solution. Web analysis, monitoring and optimization

Die Webanalyse (auch als „Reichweitenmessung" bezeichnet) dient der Auswertung der Besucherströme unseres Onlineangebots und kann Verhalten, Interessen oder demografische Informationen zu den Besuchern, wie beispielsweise Alter oder Geschlecht, als pseudonyme Werte umfassen. Mithilfe der Reichweitenanalyse können wir zum Beispiel erkennen, zu welcher Zeit unser Onlineangebot oder dessen Funktionen beziehungsweise Inhalte am häufigsten genutzt werden, oder zur Wiederverwendung einladen. Ebenso ist es uns möglich, nachzuvollziehen, welche Bereiche der Optimierung bedürfen.

Unless otherwise stated below, profiles, i.e. data collected for a usage process, can be created and information stored in a browser or in a terminal device and then read out. The information collected includes in particular visited websites and elements used there as well as technical information, such as the browser used, the computer system used as well as information on usage times. If users have agreed to collect their location data to us or to the providers of the services used by us, the processing of location data is also possible.

In addition, the IP addresses of the users are stored. However, we use an IP masking procedure (i.e. pseudonymization by shortening the IP address) to protect the users. Generally, in the context of web analysis, A/B testing and optimization, no clear data of the users (such as e-mail addresses or names) are stored, but pseudonyms. This means that we as the providers of the software used do not know the actual identity of the users, but only the information stored in their profiles for the purpose of the respective processes.

Information on legal bases: If we ask the users to consent to the use of third-party providers, the legal basis of the data processing constitutes consent. Otherwise, the user data will be processed on the basis of our legitimate interests (i.e. interest in efficient, economic and recipient-friendly services). In this context, we would also like to point out the information on the use of cookies in this privacy policy.

  • Google Analytics: We use Google Analytics to measure and analyse the use of our online offer on the basis of a pseudonymous user identification number. This identification number does not contain any unique data, such as name or e-mail addresses. It is used to assign analysis information to a device in order to recognize which content the users have accessed within one or different usage processes, which search terms they have used, have called up again or interacted with our online offer. Likewise, the time of use and its duration are stored, as well as the sources of the users who refer to our online offer and technical aspects of their terminal devices and browsers.
    In doing so, pseudonymous profiles of users with information from the use of different devices are created, whereby cookies can be used. Google Analytics does not log and store individual IP addresses for EU users. However, Analytics provides rough geographical location data by deriving the following metadata from IP addresses: City (and the derived latitude and longitude of the city), continent, country, region, subcontinent (and ID-based counterparts). In EU data traffic, IP address data is used exclusively for this derivation of geolocation data before they are deleted immediately. They are not logged, are not accessible and are not used for further uses. Einsatz von Künstlicher Intelligenz

Wir setzen im Rahmen unseres Onlineangebotes Dienste von Drittanbietern im Bereich der Künstlichen Intelligenz (KI) ein. Diese Dienste werden serverseitig genutzt, um Inhalte zu erstellen, zu übersetzen, zusammenzufassen oder Bilder zu generieren. Es werden dabei keine personenbezogenen Daten der Nutzer an die KI-Anbieter übermittelt. Die Verarbeitung betrifft ausschließlich redaktionelle Inhalte (z. B. Artikeltexte, Überschriften, Zusammenfassungen) und erfolgt ohne Bezug zu den Daten einzelner Webseitenbesucher.

Auf der Webseite veröffentlichte Inhalte (Texte, Zusammenfassungen, Bilder) können ganz oder teilweise mithilfe von KI-Systemen erstellt oder bearbeitet worden sein. Wir kennzeichnen solche Inhalte nach Möglichkeit entsprechend.
